Agreement

These terms are an agreement between you and the operator of TempoWx ("we", "us"). By creating an account or using TempoWx on any device or on the web, you agree to them. If you do not agree, do not use TempoWx.

You must be at least 13 years old to use TempoWx, and old enough to agree to these terms where you live.

TempoWx is not a weather briefing

TempoWx is a planning aid. It is not an official weather briefing, it is not approved or endorsed by the FAA or the National Weather Service, and it is not a dispatch release or a flight authorization tool.

Before every flight, get an official briefing (for example from Flight Service or 1800wxbrief.com) and check NOTAMs, TFRs and every other source the regulations and your training require. TempoWx does not show NOTAMs or TFRs.

TempoWx does not tell you whether to fly. Its decision states (such as "Favorable", "Review" or "Below minimums") only compare the weather data it has with the personal minimums you entered. They are not advice, and a favorable state does not mean a flight is safe or legal.

The pilot in command is responsible

The pilot in command is directly responsible for, and is the final authority as to, the operation of the aircraft (14 CFR 91.3), and must become familiar with all available information concerning the flight, including weather reports and forecasts (14 CFR 91.103). Using TempoWx does not change or share that responsibility.

You are responsible for the minimums, aircraft limits and other settings you enter, and for not relying on TempoWx when it is out of date, unavailable or wrong.

Weather and other data

Weather comes from third parties, mainly aviationweather.gov (NOAA), and terrain from Open-Meteo and the USGS. We do not create or control this data. It can be delayed, incomplete, missing, misinterpreted by TempoWx, or wrong, and a source can stop at any time.

TempoWx shows the source and age of each product so you can judge it. Alerts and pushes depend on background checks, networks, your device and third-party delivery services, and can arrive late or not at all. Never rely on an alert, or on the absence of one.

Your account

Keep access to your email account secure: it is how you sign in. You are responsible for activity on your TempoWx account.

You can delete your account at any time in the app (Profile → Delete account). The privacy policy explains what we keep and how deletion works.

TempoWx Pro subscriptions

TempoWx is free to use, with optional paid features called TempoWx Pro. Pro is sold as an auto-renewing subscription through the Apple App Store or Google Play, which handle payment.

A free trial, where offered, starts when you subscribe. Unless you cancel at least 24 hours before the trial or the current period ends, the subscription renews and you are charged the price shown when you subscribed for the next period. An introductory price applies only to the period stated, after which the regular price applies.

Manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops the next renewal; Pro stays on until the end of the period you paid for. Refunds are handled by Apple or Google under their policies.

Deleting your TempoWx account does not cancel a store subscription. Cancel it in the store first.

We may change prices or what Pro includes. A price change takes effect at your next renewal, after the notice and any consent the store requires. Weather products, sources and disclaimers are never limited to Pro.

Acceptable use

Use TempoWx only for lawful purposes. Do not copy, scrape or resell its data or features, interfere with or overload the service, try to get around its limits or security, or reverse engineer the app except where the law allows it.

Shared briefing links are snapshots meant for the people you send them to. You are responsible for whom you share them with.

License

We grant you a personal, non-exclusive, non-transferable license to use TempoWx on devices you own or control, under these terms and, for the app stores, their usage rules. TempoWx, its design and its software remain ours.

No warranty

TempoWx is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, timeliness and non-infringement. We do not warrant that TempoWx will be uninterrupted, error-free or that its data is correct.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from flight decisions, aircraft operation, delay, cancellation, injury, death or property damage connected with your use of TempoWx or its data.

Our total liability for any claim relating to TempoWx is limited to the greater of the amount you paid for TempoWx in the 12 months before the claim, or US $50.

Some places do not allow some of these limits, so they apply to you only as far as the law there permits.

Indemnity

You agree to defend and indemnify us against claims by third parties arising from your flights, your breach of these terms, or your misuse of TempoWx.

Changes and ending

We may update these terms. If a change is material, we will tell you in the app before it takes effect; continuing to use TempoWx after that means you accept it.

We may suspend or end access for anyone who breaks these terms. You can stop using TempoWx and delete your account at any time. The sections on responsibility, data, warranty, liability and indemnity survive.

Apple App Store

If you got TempoWx from the Apple App Store: these terms are between you and us, not Apple. Apple is not responsible for TempoWx or its content and has no obligation to provide maintenance or support for it.

If TempoWx fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the fullest extent the law allows, Apple has no other warranty obligation regarding TempoWx. We, not Apple, are responsible for addressing any claims about TempoWx, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims.

You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
